Muzenda’s bid to stop Ndarama SDA elections hits brick wall

MASVINGO – Masvingo High Court judge Sunsley Zisengwe has foiled Ndarama SDA chair Ray Muzenda’s bid to stop tomorrow’s elections after he struck off the matter off the urgent matters role today.

 Ndarama High head  Oddy Matongo and Masvingo PED Shylette Mhike were represented by Talent Undenge from the attorney general’s office while Peter Mutisi  who was the third respondent stood in person.

Muzenda through his lawyer Johanes Ruvengo of Ruvengo Maboke legal practitioners filed an urgent chamber application seeking to bar the elections that are slated for tomorrow saying the elections flouted statutory instrument 378/98 that guides the holding of SDA elections.

However judge Zisengwe ruled that the matter is not urgent since the announcement to hold tomorrow’s elections was made on June 17 and there was ample time to file a notice of opposition instead of filing an urgent chamber application on the eleventh hour.

The elections came about after Muzenda approached the magistrates court on May 27 challenging the April 9 AGM elections that toppled him.

The court order reinstated Muzenda but ordered the school to hold fresh elections within 21 days of the granting of the order which made the school head Oddy Matongo to come up with July 30 as the date of the elections.

On July 6 Muzenda filed another application seeking to stop the elections but however judge Zisengwe said the elections will go on as they could only have been stopped by an appeal or a review as Muzenda’s application goes under normal High Court procedure which would take a long time to be concluded.
