High court dismisses Chamisa tree planting urgent application

MASVINGO–High Court judge, Justice Garainesu Mawadze yesterday dismissed an urgent chamber application by Citizens Coalition for Change (CCC) lawyers to overturn a Police decision barring the party from holding a tree planting day in Gutu.

CCC was represented by Martin Mureri of Matutu Mureri Legal Practitioners. Justice Mawadze said the application was not urgent when he dismissed it.

The tree planting day was set for today at the Takaona homestead in Ward 4, Gutu North.

The High Court appeal came after CCC structures in Gutu sought Police clearance on December 12 which was turned down by Officer Commanding Masvingo East District Chief Superintended Taurai Mambure.

Mambure issued a prohibition notice to Champion Llyod Mupfudze of Hwiru, Gutu who applied for the clearance noting that another political party had applied to hold an event in the same ward on the same day. The prohibition notice is dated December 12, 2022.

“You are being advised that another political party had already made a notification to hold a political meeting on the same date and ward.

“Now therefore I as the regulating officer do hereby issue this prohibition notice in terms of section 8(9) of Maintenance of Peace and Order Act [Chapter 11:23] that any person who knowingly opposes or fails to comply with this prohibition notice shall be guilty of an offence and liable to a fine not exceeding level 14 or to imprisonment for a period not exceeding one year or to both such fine and such imprisonment,” reads the prohibition notice written by Mambure.
