Gutu RDC dragged to court over wages

MASVINGO-Gutu Rural District Council (RDC) has been dragged to the National Employment Council (NEC) by three former employees over unlawful termination of employment, underpayment of salaries and nonpayment of terminal benefits.
The Mirror has a copy of the application dated August 4, 2023.
Fainos Zivave, Panganayi Mhazo and Herbert Chuwe are represented by Ndlovu and Hwacha Legal Practitioners in the matter.
The trio were employed as security guards. They allege that their contracts were abruptly terminated in clear violation of the provisions of their Labour Act Chapter 28:0.
Mhazo, Zivave and Chuwe served council for 19, 16 and 14 years respectively. They were all dismissed this year.
The local authority is arguing that the trio were employed as casual workers and are therefore not entitled to terminal benefits.
“Further our clients have instructed us that during the period of employment they were underpaid and were not afforded the opportunity to go on leave in terms of the provisions of the Act.
“Our clients are of the firm view that they were permanent employees. In view of the above our clients have instructed us to refer their dispute or unfair labour practice to you…,” reads part of the application.
