Chivhu – There was real life drama at the Chivhu Magistrates Court on Tuesday when an accused man went and knelt before his severely injured brother and profusely apologised for the savage attack he made on him.
The scene touched many in the court including magistrate Fadzai Mutombeni who consented to a withdrawal of the attempted murder charge against Hero Gamba Mutiti (40).
However, Mutombeni gave a lesser sentence against the accused and ordered him to pay a fine of RTGS$10 000.
Mutiti was dragged to court for savagely attacking his brother Isaac Muringani (36) with an axe following an argument over a mobile phone.
He pleaded guilty to the charge.
It is the State case that on June 21, 2020 at around 2pm at Sango Village under Chief Nyoka the two brothers were drinking traditional beer at Chekerwe homestead when they had an altercation over a cellphone.
Mutiti ended up assaulting Muringani with fists twice on his mouth and he landed on the ground. Mutiti also used a log and an axe to beat Muringani.
Muringani who fell unconscious after he was hit once with an axe on the head was taken to Chivhu Hospital and a medical report was produced in court.
Muringani through prosecutor Audrey Mupini applied for the withdrawal of the attempted murder charge.
Muringani told the court that he withdrew the case because his brother is a bread winner. He also and they reached an understanding. https://masvingomirror.com
